1. About These Terms

These Terms of Use and Disclaimer ("Terms") apply to every person who visits, browses, registers with, advertises on, purchases from, or otherwise uses LushJoy and any related pages, features, tools, forms, hosted profile pages, microsites, or optional website services we make available (together, the "Platform").

By using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional policies or guidelines we publish on the Platform from time to time. If you do not agree, you must stop using the Platform.

For the purposes of these Terms, "LushJoy", "we", "us", and "our" refer to the operator of the Platform under the LushJoy brand name. We may update business or operational details from time to time without changing the substance of these Terms.

2. What LushJoy Is, and Is Not

LushJoy (www.lushjoy.ch) is a privately operated online directory and advertising platform for adult service providers and related profile-based promotions. We provide publishing tools, profile listings, optional visibility upgrades, review features, promotional campaign tools, and in some cases additional digital services such as profile support, hosted pages, or website management.

LushJoy is not an escort agency, booking agent, introducer, employer, principal, manager, or participant in any arrangement between users. We do not arrange, supervise, control, direct, or guarantee any meeting, booking, communication, payment between users, or the quality, legality, safety, availability, truthfulness, or outcome of any advertised service.

Any interaction, negotiation, screening process, booking, payment arrangement, cancellation, dispute, or in-person meeting is solely between the people involved. You use the Platform at your own risk.

3. Eligibility and Age Requirements

The Platform is for adults only. You must be at least 18 years old, and also above the age of majority in the jurisdiction where you access or use the Platform, whichever is higher.

By using the Platform, you confirm that:

• you are legally able to enter into a binding agreement;
• you are using the Platform of your own free will;
• you are not accessing the Platform on behalf of a minor;
• you will comply with all laws, rules, codes, and regulations that apply to you and your use of the Platform.

We have zero tolerance for content or conduct involving minors, exploitation, coercion, trafficking, or non-consensual activity. We may remove content, suspend access, preserve records, and cooperate with lawful requests from relevant authorities where appropriate.

4. Account Registration, Access, and Verification

Certain features are only available to registered members. You must provide current, accurate, and complete information when creating or maintaining an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

We may ask for identity, age, ownership, or authenticity checks at any stage, including before publishing or restoring a profile. Verification checks help us operate the Platform, but they do not amount to a guarantee, endorsement, or certification that any user is truthful, lawful, safe, available, or suitable for any purpose.

You must promptly update your account details if they change. You must not create misleading accounts, impersonate another person, share account access without permission, or attempt to bypass any verification, moderation, security, or payment controls.

5. Advertiser Responsibilities

If you publish a profile, review response, campaign, event, duo listing, hosted page, website content, or any other advertising or promotional material on LushJoy, you are solely responsible for it.

You represent and warrant that:

• your content accurately represents you, your offering, or the person or business being advertised;
• you own, control, or have permission to use all text, images, videos, branding, testimonials, links, and other material you submit;
• your content does not infringe privacy rights, copyright, trade marks, image rights, or any other rights of a third party;
• your content and conduct comply with all laws applicable to you and the jurisdictions in which you advertise or operate;
• any statements you make about identity, age, availability, services, rates, travel, reviews, or experiences are your responsibility.

If we provide optional support such as copy assistance, layout help, profile setup, hosting, or website management, that support is administrative or technical only. It does not transfer legal responsibility for your content or your activities to us.

6. Client and Visitor Responsibilities

If you browse listings, contact advertisers, submit enquiries, leave reviews, save favourites, or otherwise use the Platform as a visitor or client, you are solely responsible for your own decisions and conduct.

You must make your own enquiries before acting on any listing or communication. You must not assume that any profile, claim, image, review, campaign, or availability notice has been independently verified by LushJoy. You are responsible for complying with the laws that apply to you, including any laws relating to advertising, communications, adult content, privacy, or in-person meetings.

7. Content, Reviews, Exclusives, and Campaign Tools

The Platform may include profile text, images, reviews, ratings, favourites, "experience" promotions, limited campaigns, loyalty perks, event listings, duo promotions, travel notices, and other user-submitted material.

Reviews and promotional cards are published content, not guarantees. We may moderate, decline, remove, reorder, summarise, or format content for operational, legal, safety, or presentation reasons, but we are not obliged to do so. Moderation does not mean we endorse or verify any statement.

If you submit content to the Platform, you grant LushJoy a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt for formatting, distribute, and promote that content in connection with operating and marketing the Platform. This licence continues for so long as reasonably necessary to operate the Platform, maintain records, or meet legal and administrative obligations.

8. Prohibited Content and Conduct

You must not use the Platform to upload, publish, request, promote, or facilitate content or conduct that is unlawful, deceptive, harmful, or inconsistent with the purpose of the Platform.

This includes, without limitation:

• any content involving minors, school imagery, age-play involving minors, or anything that appears to depict or suggest underage persons;
• coercion, trafficking, exploitation, non-consensual conduct, blackmail, threats, or abuse;
• impersonation, catfishing, fake reviews, fake bookings, identity fraud, payment fraud, or chargeback abuse;
• doxxing, harassment, stalking, hateful conduct, or disclosure of personal or confidential information without authority;
• malware, phishing, scraping, bots, reverse engineering, automated extraction, security testing without permission, or attempts to disrupt the Platform;
• content that infringes copyright, trade marks, privacy, or other third-party rights;
• deceptive links, spam, unlawful payment funnels, or links to unrelated, misleading, or malicious sites.

We may determine, in our sole discretion, whether content or conduct is unacceptable, and may act without prior notice where reasonably necessary.

9. Payments, Subscriptions, Renewals, and Refunds

Some features of LushJoy are paid. By purchasing a plan, add-on, hosted page, website service, or other paid feature, you agree to pay the fees displayed at the time of purchase together with any taxes, processing fees, or currency conversion charges that may apply.

Unless we state otherwise:

• subscriptions renew automatically for the selected billing cycle;
• fees are payable in advance;
• upgrades, downgrades, campaign placements, and add-on services may take effect immediately or on your next billing cycle, depending on the feature;
• all amounts are non-refundable except where required by applicable law or where we expressly agree otherwise in writing.

If a payment fails, is reversed, is disputed, or becomes subject to a chargeback, we may pause, remove, or limit the affected services while the matter is reviewed. Reasonable recovery or administration costs may be charged where permitted by law.

10. Optional Hosting and Website Support

Where included with a membership or purchased separately, LushJoy may offer hosted profile pages, bonus websites, page setup, updates, or managed website support.

These services are provided on an administrative and technical basis only. Unless expressly agreed otherwise in writing:

• you remain responsible for the legality, accuracy, and ownership of all materials supplied for your website or hosted page;
• you are responsible for reviewing all live content and notifying us of corrections;
• we do not guarantee uninterrupted hosting, ranking outcomes, enquiry volume, or business results;
• we may rely on third-party hosting, domain, email, analytics, payment, or software providers in delivering those services.

Support inclusions, turnaround expectations, and feature scope may vary by plan.

11. Moderation, Removal, and Suspension

We reserve the right, but not the obligation, to review content, investigate complaints, refuse listings, decline edits, limit visibility, suspend services, remove content, or terminate accounts at any time where we believe it is appropriate for operational, legal, payment, policy, reputational, or safety reasons.

We may act with or without notice where reasonably necessary. We are not required to publish, continue publishing, or restore any profile, review, campaign, image, hosted page, or account.

If your account is suspended or closed, you must stop using the affected services immediately. We may retain records where reasonably necessary for compliance, disputes, chargebacks, fraud prevention, enforcement, or business administration.

12. Third-Party Platforms and Links

The Platform may contain links to personal websites, social media accounts, payment processors, mapping tools, embedded media, analytics tools, or other third-party services. We do not control those services and are not responsible for their content, availability, conduct, privacy practices, security, or terms.

Any dealings you have with a third-party provider are between you and that provider. Your use of third-party services is at your own risk.

13. Intellectual Property

The LushJoy name, branding, site design, platform layout, software, graphics, copy created by us, and other original materials on the Platform are protected by intellectual property laws. Except as expressly allowed by law or by us in writing, you must not copy, reproduce, republish, frame, scrape, distribute, sell, reverse engineer, or commercially exploit any part of the Platform.

You retain ownership of the content you lawfully submit, subject to the licence you grant to us under these Terms. If you believe content on the Platform infringes your rights, contact us using the details published on the Platform with sufficient supporting information for review.

14. Safety Reporting and Unlawful Activity

If you become aware of suspected underage content, trafficking, coercion, exploitation, non-consensual material, identity misuse, or other serious misconduct connected to the Platform, you must report it promptly through the reporting tools or contact details provided on the Platform.

We may investigate reports, request information, remove or restrict content, suspend accounts, preserve records, and cooperate with lawful requests from regulators or law-enforcement bodies where appropriate. We are not obliged to mediate disputes between users, but may take action where the Platform or its users may be at risk.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, LushJoy disclaims all representations, warranties, and guarantees, whether express, implied, statutory, or otherwise, including as to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, compatibility, security, or results.

We do not warrant that:

• the Platform will be uninterrupted, error-free, or free from harmful code;
• content on the Platform is complete, current, accurate, lawful, or reliable;
• any advertiser, visitor, review, favourite, enquiry, booking, or campaign will be genuine, suitable, safe, or successful;
• any paid feature will produce a particular commercial outcome, level of visibility, or volume of enquiries.

You are solely responsible for your use of the Platform and for verifying information before relying on it.

16. Limitation of Liability

To the fullest extent permitted by law, LushJoy and its operators, contractors, service providers, and representatives are not liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, or for any loss of profits, revenue, business, opportunity, goodwill, data, or reputation arising out of or in connection with the Platform, any listing, any user content, any review, any communication, any meeting, any third-party service, or any inability to use the Platform.

Where liability cannot be excluded, our aggregate liability is limited, at our option, to resupplying the relevant services or paying the reasonable cost of having them resupplied, or if that is not applicable, to the amount paid by you to us for the specific service giving rise to the claim in the 3 months before the event complained of.

17. Indemnity

You agree to indemnify and keep indemnified LushJoy and its operators, contractors, and representatives against any claim, demand, loss, damage, liability, cost, or expense (including reasonable legal costs) arising out of or connected with:

• your content;
• your use of the Platform;
• your dealings with another user or third party;
• your breach of these Terms;
• your breach of any law or the rights of another person.

18. Privacy and Records

By using the Platform, you agree that we may collect, use, store, and disclose information in accordance with that policy and as otherwise permitted or required by law.

We may keep operational logs, moderation notes, transaction records, support communications, and related materials for as long as reasonably necessary for business, legal, safety, fraud-prevention, and evidentiary purposes.

19. Changes to the Platform or These Terms

We may update, replace, suspend, or discontinue any part of the Platform, any feature, any plan, any promotional tool, or these Terms at any time. Changes take effect when posted, unless a later date is stated.

Your continued use of the Platform after updated Terms are published constitutes acceptance of the updated Terms. If you do not agree to a change, you must stop using the Platform and, if applicable, cancel your subscription before the next billing cycle.

20. Governing Law and Contact

These Terms are governed by the laws of the jurisdiction from which LushJoy is hosted and operated, presently Netherlands, unless a different jurisdiction is expressly stated on the Platform. You submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
